Acceptable Use Policy (AUP)
Preamble
Copy link to “Preamble”This acceptable use policy (the “AUP”) sets out which content and which behaviour are allowed on desioart (desioart.com) and which are not. It applies to every user — fans, creators, co-performers and the AI personas we operate ourselves — and forms an integral part of our terms of service (see Terms section 19). It covers everything you do on the platform and, where a breach is serious, platform-related behaviour away from it too.
It is supplemented by:
- the community guidelines (Community) — how we treat one another, in detail
- the rules for public media (Creator Terms section 5.5) — what may be visible to everyone before they subscribe
- the content moderation policy (Moderation) — how we detect breaches and deal with them
- the complaints policy (Complaints) — how to report a breach
- the appeals policy (Appeals) — how to challenge a decision of ours
Where you breach this AUP we reserve the right to remove content, to suspend your account temporarily or to close it permanently, following the enforcement model described in section 9. Every measure comes with reasons and can be challenged.
1 Scope and conditions of use
Copy link to “1 Scope and conditions of use”1.1 Scope
Copy link to “1.1 Scope”This AUP covers:
- all uploaded content (posts, photos, videos, audio, voice notes, profile pictures, intro videos, banners, promotional covers, bio texts, captions, polls)
- all messages (direct messages, broadcasts, automated messages, pay-per-view messages, custom request correspondence, attachments)
- all interactive features (comments, likes, tags, tip menus, tip goals, media links, tracking links, cross-posting previews)
- all profile content (username, stage name, bio, tags, categories, social links)
- all account and platform behaviour, including the use of our interfaces and of third-party apps
1.2 Who may not use the platform
Copy link to “1.2 Who may not use the platform”The platform may not be used by anyone who
- has not turned 18 (an attempt by a minor to register leads to a permanent ban on future accounts as well);
- has previously been permanently excluded from the platform (Terms section 11.6);
- has been convicted of a sexual offence, appears on a register of such offences or is subject to notification requirements because of one. We do not ask about this and process no data on it; the rule is a condition of use, and breaching it entitles us to close the account as soon as we learn of it.
1.3 The law of your country and our rules
Copy link to “1.3 The law of your country and our rules”You must obey the law of the country you are in and access the platform from. Where the law of your country allows more than this AUP does, this AUP prevails: we moderate by our own rules. Where the law of your country forbids more, keeping to it is your responsibility; we can restrict content by region (geoblocking, Terms section 2.3).
2 ZERO TOLERANCE — immediate ban without warning
Copy link to “2 ZERO TOLERANCE — immediate ban without warning”The content and conduct listed below lead to an immediate and permanent ban of the account: no warning, no reminders, no second chance. Where appropriate we bring criminal proceedings, we preserve the evidence, and we co-operate fully with law enforcement and supervisory authorities. Where there is only a suspicion, we suspend the account provisionally and take the content concerned down at once, preserve the evidence and investigate; the permanent ban is imposed after a four-eyes review (section 9.1). Merely linking to content of this kind on another platform counts as a breach in its own right.
2.1 Content involving minors
Copy link to “2.1 Content involving minors”- Any depiction of a minor (a person under 18) in a sexual, suggestive or adult context — including as a background figure in adult content
- “Age play” — depictions in which adults are presented as minors (“schoolgirl” or “schoolboy”, “barely legal” or “teen” as an activity or advertising term, infantilising staging, school uniforms in a sexual context)
- Content with cartoon, anime, animated or AI-generated figures that look or feel like minors — prompt details, stated ages in the text and disclaimers do not cancel out a depiction that reads as a minor
- Grooming behaviour, approaching minors, publishing personal data or locations of minors, playing down or glorifying violence against or abuse of minors
- Evidence that a user abuses or exploits minors away from the platform likewise leads to a permanent ban
- We report content of this kind to the competent bodies without delay (NCMEC, the Bundeskriminalamt, the Cyprus Police, the IWF and INHOPE) — matches from our automatic hash check are reported without a human looking at the material (Terms section 3.4).
2.2 Non-consensual content
Copy link to “2.2 Non-consensual content”- “Revenge porn” and non-consensual intimate imagery (NCII), whether AI-generated or manipulated (“deepfakes”, “face swaps”) or not
- Covert recordings made without the knowledge or agreement of the people filmed or photographed, including in semi-public places
- Hacked, stolen, leaked or otherwise unlawfully obtained intimate content — including reselling or redistributing another creator’s content, from this platform or any other
- Sending explicit content unasked to people who have not agreed to receive it (“cyberflashing”) — see section 7.3
- Our takedown procedure is in NCII Takedown
2.3 Depictions of violence and of self-endangerment
Copy link to “2.3 Depictions of violence and of self-endangerment”- Real depictions of torture, killing, grievous bodily harm or suicide
- “Snuff” content, and simulated material staged with realistic injury or killing
- Brutal, non-consensual acts; sexual acts under violence or threat, or carrying a risk of injury
- Encouraging, instructing in, glorifying or playing down suicide, self-harm, eating disorders or dangerous eating practices
2.4 Animals and bestiality
Copy link to “2.4 Animals and bestiality”- Any content showing animals in a sexual context
- Cruelty to animals, real or simulated violence against animals, putting animals at risk
- Suggestive staging involving animals
2.5 Illegal substances, weapons, terrorism, criminal acts
Copy link to “2.5 Illegal substances, weapons, terrorism, criminal acts”- Depicting, advertising or trading in illegal drugs, or in prescription medicines outside lawful supply
- Depicting, advertising or trading in weapons, explosives or ammunition — including as a prop in adult content
- Instruction in or promotion of criminal acts; selling regulated or counterfeit goods
- Terrorist content: content that advertises, glorifies, supports or recruits for terrorist or violent extremist organisations, ideologies or acts — without any exception. We remove such content within one hour of an order from an authority (Regulation (EU) 2021/784)
2.6 Hate and discrimination
Copy link to “2.6 Hate and discrimination”- Hate speech based on race, ethnic origin, nationality, immigration status, religion, caste, sex, sexual orientation, gender identity or expression, disability, serious illness, age or any other protected characteristic — content, that is, which on that ground disparages, dehumanises, excludes or threatens people or groups, or calls for hatred or violence against them, slurs included
- Calls for violence against, discrimination against, segregation of or persecution of groups of people
- Symbols and insignia of unconstitutional and terrorist organisations, and content playing down what they did
- Sexual content that glorifies humiliation or discrimination on the ground of a protected characteristic
2.7 Breaches involving identity
Copy link to “2.7 Breaches involving identity”- Identity theft (holding yourself out as another real person, including a celebrity, another creator or a member of our staff)
- Doxxing — publishing a person’s private data without their agreement: legal name, address, workplace, contact details, location, identity-document, banking or health data, private messages, metadata embedded in files, or data compiled from outside sources
- Using someone else’s legal name, identity documents or verified identity
- Parody and satire are allowed only where they are clearly marked as such, are recognisable as such to the audience, and suggest no connection with or endorsement by the person parodied
2.8 Incest themes
Copy link to “2.8 Incest themes”- Depictions or scenarios with incest themes — even where marked as fiction or as “step-family roleplay”
- Verbal allusions to incest themes where they assert a family relationship
2.9 Real people without verification and consent
Copy link to “2.9 Real people without verification and consent”- Content in which a person appears who is not verified through the platform’s consent system and has not agreed to publication (Creator Terms section 9.4, 2257 Statement) — whether as the main subject or recognisable in the background
- Content that purports to show a particular real person (a celebrity, another creator, a private individual) who is not taking part — in a fictional or satirical context as well
- AI-generated or AI-altered content showing real people without their documented consent (“deepfakes”) — even where marked as satire or as fiction (section 4)
- Recognisability: every person in adult content must remain identifiable to us (verification plus attribution for each item of media). Masks, coverings and pixelation may not be used to conceal a person who is not verified or has not consented; verified people may cover their faces where they are clearly attributed to the item
2.10 Compliance breaches
Copy link to “2.10 Compliance breaches”- Adult content without verified performers, or without 2257 compliance confirmation
- False statements in identity or age verification, or in tax or banking details
- Money laundering, terrorist financing, funds of criminal origin, use of the platform as a laundering vehicle (structuring, smurfing, layering); where there is a mere suspicion, the third sentence of section 2 applies
2.11 Human trafficking and modern slavery
Copy link to “2.11 Human trafficking and modern slavery”- Any indication of forced sex work, human trafficking, smuggling or exploitative arrangements
- Suspicion that content is being produced under coercion, threat, deception or dependency
- Controlling or coercive behaviour towards partners, former partners or family members through the platform — pressure to publish content, taking over or monitoring someone else’s account, stalking
- Where we suspect this: immediate suspension, preservation of evidence, a report to the competent authorities (see Anti-Slavery)
2.12 Sexual services, meetings and the exploitation of adults
Copy link to “2.12 Sexual services, meetings and the exploitation of adults”- Offering, requesting, arranging or brokering real sexual services or in-person meetings for payment (escort work, “meet-ups”, “dates”) — including in veiled form or through code words
- Recruiting, encouraging or coercing people into prostitution, or into monetising intimate content against their will
- Using the platform to set up transactions that are not platform transactions (meeting in person, delivering off-platform for money)
2.13 Blackmail and sextortion
Copy link to “2.13 Blackmail and sextortion”- Threatening to publish or pass on intimate content in order to obtain money, further content or any other advantage
- Demanding money or an advantage in return for removing content
- Fraudulently inventing emergencies, identities or services in return in order to obtain payment
3 Strict rules for roleplay, kink and fantasy themes
Copy link to “3 Strict rules for roleplay, kink and fantasy themes”Adult content may explore fantasy themes — so long as it shows nothing but consenting adults and keeps to the strict limits below:
3.1 Allowed, with marking
Copy link to “3.1 Allowed, with marking”- BDSM and kink, where everyone involved is an adult, consent is plainly visible and none of the practices named in section 3.2 is shown
- Roleplay scenarios between adult characters where identity is unambiguous
- Fantasy settings with adults taking part
- Artistic or erotic depictions with clear marking
3.2 Prohibited — even when marked as “fiction”
Copy link to “3.2 Prohibited — even when marked as “fiction””- Incest themes (see section 2.8) — “step-family” roleplay included
- Age play — adults depicted or staged as minors (section 2.1)
- Coercion or rape scenarios — acted, simulated or labelled “fantasy” or “CNC” alike; any scenario built on absent consent
- People asleep, unconscious, drugged, or staged as such, in a sexual context
- Choking, strangulation, breath control and suffocation; heavy bondage carrying a risk of injury; blood play; genital mutilation; practices carrying a serious risk of injury — including where a safety note is added or the material is marked “consensual”
- Bodily waste (urine, faeces, vomit) in a sexual context
- Necrophilia and depictions of the dead in a sexual context
- Hypnosis and mind-control scenarios that stage the absence or removal of the depicted person’s consent
- Pregnancy themes with a connotation of minors
- Objects or acts capable of causing physical or psychological harm, and extreme impact or extreme bondage
- Sexual humiliation on the ground of a protected characteristic (section 2.6)
3.3 Required marking
Copy link to “3.3 Required marking”BDSM, roleplay and fantasy content must make clear that:
- everyone involved is an adult
- the act is consensual
- the content is classified correctly as adult (content level) and tagged to match
3.4 Public places
Copy link to “3.4 Public places”Sexual acts and nudity are not allowed where they were recorded in a public place with uninvolved people present or reasonably able to watch (streets, shops, parks, public transport), nor are nude recordings made in countries or regions where public nudity is a criminal offence. Private land, enclosed spaces and remote places with no audience are fine; uninvolved people must never be recognisable (section 2.9).
4 Rules for AI-generated and AI-altered content
Copy link to “4 Rules for AI-generated and AI-altered content”4.1 The principle: allowed, with labelling
Copy link to “4.1 The principle: allowed, with labelling”AI-generated and AI-altered content (images, video, audio, text and voices, including face swaps, synthetic voices and generated people) is allowed where
- it is declared as AI-generated on upload — the platform then attaches a visible label and a machine-readable marking under Article 50 of the AI Act (Regulation (EU) 2024/1689); declaring it falsely is a breach;
- AI creators (account type “AI”) disclose permanently in their profile that the persona shown is not real;
- AI-produced messages (AI tools, AI avatar replies, AI personas) are marked as such — and the marking is neither removed nor circumvented;
- it keeps to every other rule in this AUP. Plain image editing (light, colour, retouching, cropping) that neither creates nor alters people, bodies or acts does not count as AI content.
4.2 Prohibitions for AI content
Copy link to “4.2 Prohibitions for AI content”- No AI content of real people without their documented, verified consent (deepfakes, face swaps, voice clones) — not of celebrities, not of other creators, not of private individuals, and not satirically either. A creator may apply AI alterations to their own verified likeness; where another real person appears, section 2.9 and Creator Terms section 9.4 apply without qualification.
- No AI content depicting minors or reading as minors — in any style at all (photorealistic, anime, cartoon, render). Prompt texts, stated ages and disclaimers do not cancel out the visual impression, and we treat such content exactly as we treat real abuse material (section 2.1).
- No deception about authenticity: AI content may not be held out as a real recording, as real live interaction or as a real person, and AI personas may not let fans believe a human being is writing to them.
- No AI content that breaches section 2 or section 3.
- Covered faces, masks and religious or cultural dress are allowed in AI content, so long as it is clearly labelled as AI and is not misleading.
4.3 How we judge it
Copy link to “4.3 How we judge it”AI content is judged by the standard of a sensible viewer (the “reasonable person test”): what matters is how the content strikes the audience, not how it was made. Public AI media (profile picture, banner, intro, promotional cover) must meet the SFW guidelines as well.
4.4 AI personas we operate ourselves
Copy link to “4.4 AI personas we operate ourselves”The same rules govern our own AI personas. They are labelled as AI and as operated by the platform, they do not write to fans unasked, and they are subject to the same moderation procedures (Terms section 4.7).
5 Account abuse and manipulation of the platform
Copy link to “5 Account abuse and manipulation of the platform”5.1 Prohibited account practices
Copy link to “5.1 Prohibited account practices”- Multiple accounts outside the “linked accounts” feature (Terms section 2.6); linked accounts may not follow, subscribe to, rate, buy from, message or advertise one another
- Account sharing (giving your credentials to anyone else) — assistants only through the features provided for them (Creator Terms section 4.7)
- Selling, buying, renting out or transferring accounts, or content acquired through the platform
- Sock-puppet accounts (fake accounts used to follow, like, comment on, rate or tip yourself); artificially inflating interactions, subscriber numbers or purchase figures
- Bots, crawlers, scrapers and scripts we have not expressly authorised; browser extensions that automate the platform without approval
- Mirroring our database, mass downloading, indexing content
- Registering again after a permanent ban, or using someone else’s account to get round one (Terms section 11.6)
- False registration details, or use of another person’s identity, payment or verification data
5.2 Prohibited payment and commission practices
Copy link to “5.2 Prohibited payment and commission practices”- Money laundering, structuring, card stacking, card testing
- Repeated unjustified chargebacks — reversing payments abusively although the service was properly delivered; a rate above 1.5 % over a rolling 30-day period always counts as such
- Self-referrals, advertising accounts you are linked to or control yourself, and any manipulation of the referral programme (Terms section 10, Referral)
- Manipulating tip goals, prices or refunds through co-ordinated fake purchases, buy-and-lower tactics or refunds (Creator Earnings section 4.4)
- Offering or asking for payment away from the platform for content or services arranged through it — including “send it back” arrangements (“return 50 % to me via …”) and external payment links
- Prize draws, raffles, gambling and investment offers without our written agreement (Advertising section 3.2)
5.3 Prohibited communication practices
Copy link to “5.3 Prohibited communication practices”- Spam: identical or substantially identical messages to many recipients outside the broadcast feature; messages to users who have blocked you or unsubscribed from your broadcasts
- Advertising to users you have no relationship with on the platform (no follow, no subscription, no purchase, no request), and advertising third-party offers by message outside the cases allowed by Advertising section 3.4
- Phishing, and attempts to obtain another user’s login credentials, payment data or verification data
- Harassment, stalking, threats, threats to dox, trolling, and contacting someone again and again after being refused or blocked
- Using code words, signals or euphemisms to communicate prohibited content or services
- Pretending that messages come from a human being when an AI produced them (section 4.1)
5.4 Misleading material and authenticity
Copy link to “5.4 Misleading material and authenticity”- Content must be what it is described and previewed as — in length, format, substance and the person appearing; misleading descriptions, bait-and-switch and false claims about live interaction are prohibited
- No pretending to a connection with, endorsement by or collaboration with desioart, our staff or any third party
- No use of our name, logo or design outside the linking allowed by Terms section 8.5
- No republishing content previously removed for a breach — not in edited form either (our systems recognise re-uploads)
6 External links and cross-platform promotion
Copy link to “6 External links and cross-platform promotion”6.1 Allowed
Copy link to “6.1 Allowed”- Links to your own social media profiles — the platform provides social links in the profile and cross-posting for this (Creator Terms section 9.8)
- Links to profiles on other adult or mainstream platforms, competing platforms included
- Links to your own websites, Linktree pages, Beacons pages and comparable profile aggregators
- Links the platform generates (profile, tracking, test and media links, QR codes) used on external channels
6.2 Prohibited
Copy link to “6.2 Prohibited”- Direct off-platform sales of paid content
- Links to third-party sites, payment services or wish lists intended to bypass the platform’s payment processing
- Links to external storage services used to deliver content
- Links to phishing, malware or scam sites
- Affiliate links of a markedly spammy character
- Links to platforms or content that would breach this AUP (a link to prohibited content is a breach in its own right)
- Advertising escort, dating or meeting-arrangement services (section 2.12)
6.3 Requirements
Copy link to “6.3 Requirements”- An external link must make the name of the platform it points to plainly visible (no disguised redirects)
- Links must be reachable over https://
- On third-party platforms your desioart profile may be advertised only with previews suitable for all audiences; where adult posts are cross-posted, the platform publishes nothing but a neutral teaser card
7 Anti-spam and platform hygiene
Copy link to “7 Anti-spam and platform hygiene”7.1 Volume and frequency limits
Copy link to “7.1 Volume and frequency limits”The activities below are limited technically. Working around them systematically counts as spam or abuse:
| Action | Limit |
|---|---|
| Direct messages to different recipients | max. 50 per 24 hours |
| Direct messages in total | max. 30 per hour; max. 200 per 24 hours per recipient |
| Pay-per-view messages to the same recipient | max. 5 per 24 hours |
| Custom requests to different creators | max. 20 per 24 hours |
| Automated messages per creator and occasion | max. 1,000 per 24 hours |
| Broadcasts from AI personas | max. 5 per 24 hours |
| Comments | max. 10 per minute |
| Uploads | max. 200 files per 24 hours |
| Searches and trending requests | max. 50 and 100 per hour respectively |
| Reports without an account | max. 5 per 24 hours |
| Identity theft reports | max. 5 per 24 hours |
| Follows, likes, poll votes, reports, invitations | limits that vary by account and device, to counter automated or co-ordinated use; where something looks irregular, an extra security check |
We may adjust these figures for security reasons; what the platform shows you at the time is what applies. Messages to many of your fans at once are allowed only through the broadcast feature, which respects recipients’ opt-outs automatically.
7.2 What counts as spam
Copy link to “7.2 What counts as spam”- Identical messages to many recipients with no connection to them
- Advertising spam for third-party sites (see section 6.2)
- Engagement bait: demanding interaction in return for a promised reward
- Mass-tagging other users for no reason
- Aggressive promotional activity (like-bombing, flooding)
- Misleading or exaggerated offers in a bio, in posts or in messages
7.3 Explicit content sent unasked
Copy link to “7.3 Explicit content sent unasked”Explicit media may be sent only to users who expect them — subscribers, buyers, or people who have expressly asked. The first message to a user you have no paid relationship with must be suitable for all audiences, and explicit attachments are not allowed in it. Fans may not send creators explicit media unasked. We treat breaches (“cyberflashing”) as non-consensual content (section 2.2).
8 Technical abuse
Copy link to “8 Technical abuse”The following are prohibited:
- Circumventing technical protection measures (access controls, age verification, watermarks, geoblocking, download blocks)
- Attempts to download, cache, record or index content automatically; downloading content outside the download features expressly provided
- Reverse engineering the platform software, the apps or the APIs, save where the law makes this a right that cannot be excluded
- Unauthorised use of API endpoints, or use of the API to get round limits, prices or moderation (see API Terms)
- Stress tests, penetration tests and DDoS attempts without our written agreement (to report a security vulnerability responsibly: security@desioart.com)
- Introducing malicious code, viruses, trojans or XSS payloads — in media files as well
- Attempting to escalate privileges, or to reach another person’s account
- Sending our servers more requests than a human being with an ordinary browser would generate
- Using VPNs, proxies or anonymising services to get round geoblocking, age verification, sanctions or payment controls, or to commit referral or payment fraud (using a VPN privately, without those purposes, is not prohibited)
9 How we enforce this (graduated measures plus immediate bans)
Copy link to “9 How we enforce this (graduated measures plus immediate bans)”Our enforcement model has two tracks:
9.1 Immediate permanent ban (zero tolerance)
Copy link to “9.1 Immediate permanent ban (zero tolerance)”Breaches of section 2 (zero tolerance), section 3.2 (prohibited practices) and section 4.2 (deepfakes and AI content reading as minors) lead to an immediate and permanent ban of the account, without warning, once a four-eyes review has been carried out; until then the account is suspended provisionally and the content is removed. Earnings are frozen; amounts connected with the breach are retained, and the rest of the balance is dealt with under Terms section 11.4 and Creator Earnings section 10 — there is no blanket forfeiture.
Where a criminal offence may be involved we pass the content and data to law enforcement or the competent authorities (NCMEC, the Bundeskriminalamt, the Cyprus Police, the IWF and INHOPE, our verification providers). Where an account holds a large number of infringing items, we may remove media in bulk.
9.2 Graduated measures (for other AUP breaches)
Copy link to “9.2 Graduated measures (for other AUP breaches)”For all other breaches — everything that does not fall under section 9.1 (zero tolerance) — we respond in steps and in proportion, depending on how serious the breach is, how often it occurs and whether it is repeated (Article 23 DSA). A typical course:
- First a warning (by email and as a note in your account), where appropriate with removal of the content concerned or, for public media, removal from discovery.
- Where the SFW guidelines for public media are breached repeatedly, we may take your profile out of public view altogether: it is then reachable only by signed-in, age-verified users and no longer appears in search, discovery or recommendations until you have replaced the media complained of.
- Where a breach is repeated, or several warnings arrive within a short time, a temporary restriction or suspension of the account (24 hours, 7 days or 30 days; content invisible, balance frozen, subscriptions running on).
- Where breaches continue or accumulate, a permanent ban.
We deliberately set no fixed number of warnings: every case is weighed on its own and in proportion. Serious breaches weigh more than slight ones, and minor warnings carry less weight once a longer stretch has passed without complaint. Warnings for child protection or NCII breaches never expire. For serious breaches, section 9.1 applies straight away. Behaviour not named here expressly, but plainly harmful to the community or to others, we may deal with on the same principles.
9.3 Statement of reasons
Copy link to “9.3 Statement of reasons”With every measure — removing content, removing it from discovery, a warning, a restriction, a suspension, a permanent ban, a retention — you receive a statement of reasons under Article 17 DSA, setting out:
- what the breach was and which content it concerned
- the particular AUP clause (or legal provision) relied on
- whether automated means played a part in detection or in the decision
- the consequences and how long they last
- your right to complain and to appeal (Complaints, Appeals) and the out-of-court dispute settlement bodies (Article 21 DSA)
Where offences against children are suspected, where an investigation is under way, or where an authority has ordered it, the reasons may be kept general (Terms section 11.7).
9.4 Seeing your active warnings
Copy link to “9.4 Seeing your active warnings”Your active warnings, your moderated content, the reasons behind them and the state of your account are visible at any time under “Account status” (/account-health), and you can appeal from there.
10 Reporting breaches
Copy link to “10 Reporting breaches”10.1 Reporting in the app
Copy link to “10.1 Reporting in the app”On every post, every comment, every profile and in every message you can click the “Report” icon and choose a reason. The categories are grouped by urgency, and in those classed as critical the content is hidden provisionally as soon as the first plausible report arrives:
Critical (dealt with within 24 hours, hidden after 1 report):
- minors, or suspected content involving minors (grooming included)
- suspected child sexual abuse material (CSAM)
- non-consensual intimate content and NCII (deepfakes of real people included)
- violence, or threats of violence
- promotion of self-harm or suicide (eating disorders included)
- terrorism and extremism
- human trafficking and sexual exploitation
- cruelty to animals and bestiality
Serious (dealt with within 7 days, hidden after 3 independent reports):
- sexual harassment
- verbal harassment, bullying, stalking
- hate speech and discrimination
- doxxing and publication of private data
- identity theft, holding yourself out as a real person (catfishing included)
- other non-consensual content
- illegal or unsafe products and services (drugs, weapons, gambling, counterfeits)
- arranging real sexual services or paid meetings
- fraud, phishing, scams, sextortion
- prohibited sexual depictions (staged non-consent, unconsciousness, public places, incest or age-play themes, bodily waste, the practices prohibited by section 3.2)
Medium (dealt with within 14 days, hidden after 5 reports):
- spam, account abuse, off-platform selling, impermissible external links, missing AI labelling
- anything else (a description is required, up to 2,000 characters)
Copyright: breaches of copyright or trade mark rights go through the separate DMCA channel (section 10.4), which has a form of its own; content reported there is removed once the notice has been examined.
We may add categories; the list shown in the reporting dialogue at the time is what applies. Reports are possible without an account too, at desioart.com/report (with a security check, up to 5 a day); we never pass the identity of the person reporting to the person reported.
10.2 Trusted flaggers under Article 22 DSA
Copy link to “10.2 Trusted flaggers under Article 22 DSA”We accept reports from trusted flaggers recognised under the DSA as a priority and deal with them first. The list of recognised trusted flaggers is in Moderation.
10.3 The NCII emergency procedure
Copy link to “10.3 The NCII emergency procedure”Where non-consensual intimate material (NCII) is reported, our 24-hour emergency procedure applies, with an accelerated takedown and — if the person affected wants it — transmission of a hash value to StopNCII.org so that the content is blocked on other platforms too. People affected can report without an account: desioart.com/nci-takedown. The details are in NCII Takedown. Direct contact: ncii@desioart.com.
10.4 The DMCA procedure
Copy link to “10.4 The DMCA procedure”For copyright infringements the DMCA procedure applies, with an online form (notice, counter-notice, repeat-infringer rule). The details are in DMCA. Direct contact: dmca@desioart.com.
10.5 General complaints
Copy link to “10.5 General complaints”For every other complaint, see Complaints. Direct contact: complaints@desioart.com.
10.6 Abusive reports
Copy link to “10.6 Abusive reports”A report must be made in good faith. Anyone who repeatedly files reports that are plainly unfounded (as a guide: five rejected reports in 30 days) loses access to the reporting feature for 7 days, and where it continues for 30 days or permanently. We detect co-ordinated mass reporting of an item or an account automatically and treat it as an attempt at manipulation (section 5.1); it does not make anything hidden any faster. A report known to be false and meant to harm another user breaches this AUP and can give rise to a claim in damages.
11 Updates to this AUP
Copy link to “11 Updates to this AUP”We may adapt this AUP to new legal, technical or regulatory circumstances. Where a change is substantial we tell you actively, at least 30 days before it takes effect, by email and in your account (creators at least 15 days, Article 3 of Regulation (EU) 2019/1150). A change required by law, or one that averts an immediate danger to users, to the platform or to others, can take effect at once, and we tell you about it without delay. Where content was permissible before a change, we allow a reasonable period to adjust, so long as there is no danger in doing so.
The current version and a record of the changes are at legal.desioart.com.
