Creator Earnings and Payouts Policy
Preamble
Copy link to “Preamble”This policy sets out in detail how you earn remuneration as a creator on desioart (desioart.com), how it is calculated, when and how it is paid to you, and what follows for tax. It supplements the creator terms (Creator Terms) and the master terms of service (Terms).
Where this policy conflicts with the creator terms or the master terms, this policy prevails for the particular subjects it governs (calculating remuneration, the payout workflow, tax reporting, AML).
1 Scope
Copy link to “1 Scope”This policy covers every creator on desioart — solo creators, creators working with co-performers or co-creators, and human-run AI creators (Creator Terms section 11). Remuneration arises from the moment your creator account is activated; payouts require stage 2 verification (section 6.2). For referral commission earned by users without a creator account, sections 5 and 6 apply accordingly, with the differences named in section 6.1. AI personas we operate ourselves receive no remuneration and fall outside this policy.
2 Sources of revenue and the commission model
Copy link to “2 Sources of revenue and the commission model”2.1 Commission on all revenue
Copy link to “2.1 Commission on all revenue”Every payment a fan makes for what you offer is treated the same way: the platform keeps 20 % as its commission and 80 % is credited to you — each on the net revenue under section 2.2, whichever feature the payment comes through. What you can offer, and in which price ranges, is set out in Creator Terms section 5.1. Remuneration from custom requests is credited to you only on delivery; until then we hold the fan’s advance payment for that purpose. All amounts are in USD, the platform currency. Tips to yourself or to linked accounts are ruled out. Referral commission (section 2.6) is not revenue from fans’ payments and carries no platform commission.
2.2 How the platform commission is calculated
Copy link to “2.2 How the platform commission is calculated”The platform commission is calculated on net revenue: the fan’s payment without consumption taxes (VAT) and after deduction of the fee the payment service provider charges us for that transaction. Chargebacks and refunds are dealt with separately under section 4. We show you the payment service provider’s fee for each transaction in your statement of account.
Note: for EU customers the VAT is legally measured in euro and accounted for through the OSS scheme; conversion from USD uses the applicable reference rate on the relevant date.
Every transaction is settled under the versioned fee policy in force when the payment was made; a change to the fee policy never applies retrospectively, and a reversal is always calculated back under the version originally applied.
2.3 Consumption taxes (VAT) on fans’ payments
Copy link to “2.3 Consumption taxes (VAT) on fans’ payments”On sales to consumers in the EU the EU One Stop Shop (OSS) scheme applies: your prices are net prices; we add the VAT of the consumer’s home country at the time of purchase, show it in the total price before the order is placed, and account for it through the Cypriot tax administration. You as creator receive your share of the net value alone. We determine a fan’s country from where they are when they order and from further indicators (Privacy).
For consumers outside the EU local consumption taxes may apply, which — where we are obliged to — we likewise add at the time of purchase and account for.
The details are in Terms section 5.2.
2.4 VAT on what you supply to us
Copy link to “2.4 VAT on what you supply to us”For VAT purposes you supply us (you provide your content in return for remuneration) and we supply the fan (Terms section 3.1; Article 9a of VAT Implementing Regulation (EU) No 282/2011). Your remuneration is therefore not a payment by a final consumer but a payment between businesses:
- If you are established in the EU outside Cyprus and are registered for VAT, the place of supply is Cyprus and we owe the VAT under the reverse charge procedure. You give us your VAT ID, and your statement shows no VAT.
- If you are a small business or are not registered for VAT, the self-billed invoice shows no VAT. Whether you need a VAT identification number, or have reporting obligations, for supplies to a business in another EU member state is something to settle with your tax adviser; we take no responsibility for it.
- If you are established outside the EU, the place of supply is Cyprus; local VAT in your own country does not usually arise on what you supply to us, but the law of your country governs.
Accounting by self-billing. We account for your remuneration by self-billing: with every payout and at the end of the year we give you a self-billed invoice carrying everything the tax rules require. You agree that we prepare the statement, and you object within 30 days if one is wrong. There is no separate arrangement for UK VAT, because for VAT purposes our supply relationship lies in Cyprus.
2.5 Items set off outside the commission
Copy link to “2.5 Items set off outside the commission”The following are not commission but are set off against your balance separately and shown individually in your statement of account:
| Item | Amount | Basis |
|---|---|---|
| Payment service provider’s fee per transaction | the actual fee, deducted before the commission is calculated | section 2.2 |
| Payout fee on small payouts | 15 % between USD 20 and 49.99 | section 6.1 |
| Network fee on a crypto payout | the payment provider’s actual network or service fee, shown before you confirm | section 5.2 |
| Fees of paid third-party services when cross-posting (currently X) | the actual cost, shown before you switch it on; without enough balance, nothing is published | Creator Terms section 9.8 |
| Chargebacks, refunds, refund fees | section 4 | section 4 |
| Fee on closure after a ban | 15 % only where the remaining balance is under USD 50 (the scale in section 6.1) | section 10.2 |
We charge nothing else.
2.6 Promotional rates and referral commission
Copy link to “2.6 Promotional rates and referral commission”We may offer promotional rates for a limited time. The rate, the conditions and the duration are published on the platform; the rate in force for a transaction is applied automatically and shown in your statement of account. Individual partner arrangements are to be made in writing.
Referral commission: for creators you refer you receive 5% of the commission base (fans’ payments to the person referred, excluding VAT, before our platform commission is deducted — Referral section 1) for 12 months from the moment the commission is unlocked, capped at USD 50,000 per creator referred. The commission arises once the person referred has earned EUR 100 and your identity has been checked (Referral sections 2.1 and 3). It is paid out of our own share, carries a hold period of 21 days, and is reversed pro rata on fraud, on a chargeback or on a refund of the underlying fan payment (Terms section 10, Referral).
3 The hold period (protection against chargebacks)
Copy link to “3 The hold period (protection against chargebacks)”3.1 The standard hold: a rolling 7-day cycle
Copy link to “3.1 The standard hold: a rolling 7-day cycle”Your available balance is remuneration you can draw down; your pending balance is remuneration still within the hold period.
Your remuneration is processed on a rolling 7-day cycle, from “pending” to “available”.
The risk exception: remuneration from payments by fans without a verified account, or with an unknown source of payment, becomes available only after 30 days. This targets chargeback protection where the risk actually sits (in the adult sector the chargeback rate runs up to 1.5 %, against 0.1 % in general e-commerce). Which hold period was applied to a credit is shown per tranche, with its expiry date, in your dashboard. Referral commission: 21 days.
3.2 A hold period based on suspicion
Copy link to “3.2 A hold period based on suspicion”On top of the standard hold period, an extended hold period can be imposed where:
| Trigger | Extension |
|---|---|
| your account’s chargeback and dispute rate reaches 1.5 % over a rolling 30-day period (a warning comes at 1.0 %) | + 30 days (37 in total) |
| KYC re-verification is outstanding (see Age Verification section 5) | until verification is complete |
| an authority requests information about your account | until the proceedings end, or the authority releases it |
| there are well-founded grounds to suspect an AUP breach, fraud or exploitation | until the matter is clear (90 days at most) |
| there is a hit on a sanctions or PEP list (EU, OFAC, UK) | until the matter is clear, after which the account may be closed |
| gross revenue rises sharply and suddenly (a possible money laundering indicator) | + 30 days and enhanced due diligence (see section 7) |
| a co-performer’s consent to remunerated content is missing or withdrawn | until the matter is clear |
| there is an attachment, assignment, insolvency or other third-party right over your balance | until the matter is clear |
We tell you by email and in the creator dashboard as soon as an extended hold period is activated, with the reason, the expected duration and the remedy open to you (section 10.3); where an official investigation is under way the reason may be kept general.
3.3 Available balance and pending balance
Copy link to “3.3 Available balance and pending balance”Your creator dashboard shows you at any time:
- Pending balance — remuneration within the hold period, per tranche and with its expiry date
- Available balance — remuneration you can draw down (the hold is over, no suspicion stands, set-offs are deducted)
- Lifetime earnings — total remuneration to date
4 Chargebacks and refunds — what they do to your remuneration
Copy link to “4 Chargebacks and refunds — what they do to your remuneration”4.1 Chargebacks
Copy link to “4.1 Chargebacks”On a chargeback (the fan’s bank reclaiming the payment) the whole gross payment goes back to the fan. You as creator bear that reversal in its full gross amount; the platform commission on the original transaction stands — the same model the leading platforms use.
Where the chargeback falls within the hold period (7 days as standard, or 30 for unverified fan accounts), your pending balance is reduced accordingly.
Where it falls after the hold period, the amount is deducted from your next available balance, so far as there is enough of it; otherwise section 4.6 applies (a negative balance).
The chargeback rate. Repeated chargebacks put the platform at risk of being cut off by its payment provider (the card networks’ thresholds are 1.0 % for a warning and 1.5 % for critical). Your dashboard shows your rolling 30-day rate as a traffic light. At a rate of 1.0 % we warn you; from 1.5 % we may impose an extended hold period (section 3.2), examine your offers and descriptions, and — where it continues despite the warning — restrict or close your account (Creator Terms section 12.3). We charge no handling fee per dispute. Chargebacks arising from proven card fraud by third parties, which you could do nothing about, we take into account when assessing your rate.
Before a chargeback: where the payment provider sends us a dispute alert, we may grant the fan a refund ourselves to avoid the chargeback; it is then treated as a goodwill refund under section 4.2.
4.2 Goodwill refunds (granted by the platform)
Copy link to “4.2 Goodwill refunds (granted by the platform)”On a goodwill refund under Terms section 6.3 you as creator bear the full gross amount of the refund, less the VAT correction to the tax authorities; the platform commission on the original transaction stands — the same model the leading platforms use. The exceptions: purely technical platform errors are corrected without any charge to your account, and we bear the pro-rata refund to fans where we impose a permanent ban on your account (the table in section 4.5; amounts connected with the breach we reclaim under section 10.2).
Where you refuse a fan’s plainly justified request for a refund (Creator Terms section 5.6), we reserve the right to grant a refund at the expense of your available balance. Before doing so we hear from you over 7 days; refunds we owe fans by law (Terms section 6.4) we may make without hearing from you first, telling you afterwards with reasons.
4.3 Refunds you initiate
Copy link to “4.3 Refunds you initiate”Where you want to grant a fan a refund voluntarily, you can start it from the creator dashboard. In that case:
- the fan gets the full gross amount back
- you are charged the gross amount — not merely your 80 %, because as the initiator you bear the whole reversal economically — less the VAT refund to the tax authorities, which arises anyway
- the platform commission on that particular transaction is not returned to you, because the platform’s service has already been performed
If you cancel a custom request not yet delivered, the fan’s earmarked advance payment is returned in full; since nothing had been credited to you, nothing is charged.
4.4 Refunds you cause (a price reduction)
Copy link to “4.4 Refunds you cause (a price reduction)”If you lower the total price of a paid collection or of a single paid item of media although the platform showed you, as you lowered it, that fans bought that offer at a higher price in the last 30 days (a warning naming the number of buyers and the possible refund volume), and you confirm the step, then:
- refunds of the price difference that we grant the fans affected as a goodwill gesture are borne by you in full and alone;
- you are charged the full gross difference (less the VAT correction to the tax authorities) plus the fee the payment provider actually charges us for that refund, which is shown to you before you confirm;
- the platform commission on the original purchase is unaffected, because the platform’s service has already been performed (as in section 4.3).
The same applies where you make an item of media that was sold for a price in the last 30 days freely available after confirming the warning shown to you.
Documented consent instead of a hearing: your confirmation of the warning is logged with a timestamp, the old and new price, the number of buyers and the possible refund volume (kept for 10 years) and counts as documented consent to that charge. There is no separate prior hearing under section 4.2. We tell you about each actual deduction individually, with a breakdown you can follow (the transaction concerned, the date the fan bought, the difference refunded, the fees).
Fans have no claim to this: fans have no right to such a refund (Terms section 6.3); we decide case by case as a goodwill matter. Buying and lowering in concert between a fan and a creator leads to measures under the acceptable use policy (Acceptable Use, the warning system), up to and including a ban on both of them.
4.5 Who bears what, in overview
Copy link to “4.5 Who bears what, in overview”| Event | Effect on the creator | Effect on the platform |
|---|---|---|
| Chargeback | −gross (the full amount) | commission stands, plus the risk to our chargeback rate with the payment provider |
| Refund after a dispute alert (avoiding a chargeback) | as for a goodwill refund | commission stands |
| Goodwill refund (granted by the platform) | −gross (the full amount) plus the VAT correction | commission stands |
| A refund owed by law for defective performance (Terms section 6.4), so far as you caused it (Creator Terms section 5.6) | −gross (the full amount) plus the VAT correction | commission stands |
| A refund you initiate | −gross (the full amount) plus the VAT correction | commission stands |
| Cancelling a custom request not delivered | neutral (nothing was credited) | bears the payment provider’s fees |
| A refund you cause (a price reduction, or making something free after the warning, section 4.4) | −the gross difference (the full amount) plus the VAT correction plus the payment provider’s actual refund fee | commission stands |
| A double or erroneous charge (technical correction) | neutral — an erroneous charge produces no remuneration, or it is reversed in full | the platform bears the provider’s fees for unwinding it |
| The pro-rata refund to fans where we ban your account permanently | neutral for the unused remainder of the subscription; amounts connected with the breach are reclaimed under section 10.2 | the platform bears the pro-rata refund |
| A fan’s crypto underpayment (nothing is unlocked) | neutral (nothing credited) | bears the processing; an overpayment of USD 0.50 or more is credited to you as a tip (Terms section 5.6) |
4.6 Negative balances
Copy link to “4.6 Negative balances”Where your pending and available balances do not cover a charge under section 4, a negative balance arises. It is set off against future credits, including those of linked accounts (Creator Terms section 2.5), and payouts are blocked until it is cleared. Where the outstanding balance exceeds USD 100 and is not cleared 90 days after it arose, we reserve the right to invoice it (Terms section 5.7). If your account closes, a negative balance falls due at once.
5 Payout methods
Copy link to “5 Payout methods”5.1 Bank transfer (SEPA)
Copy link to “5.1 Bank transfer (SEPA)”Payment by SEPA transfer to a bank account in the SEPA area registered in your own name or your registered business name.
This requires:
- a completed stage 2 identity check (see Age Verification)
- your IBAN and BIC entered correctly in the creator dashboard
- an account in your own name (no third-party account, and no partner’s account unless you are entitled to it jointly — protection against exploitation, Anti-Slavery)
- for business accounts, proof that you are entitled as the business owner
New or changed bank details take effect only 7 days after they are confirmed; during that time we tell you by email and you can cancel the change (protection against account takeover). The accuracy of your bank details is your responsibility, and you bear the cost of transfers that fail because they were wrong. Bank accounts outside the SEPA area are not supported at present.
5.2 Cryptocurrency (stablecoin)
Copy link to “5.2 Cryptocurrency (stablecoin)”Where offered, you can have your balance paid out through our crypto payment provider in a US-dollar-pegged stablecoin (which one is shown to you before you confirm; we tell you in advance of any move to another USD stablecoin) to a wallet address you have entered:
- You enter the wallet address with a fresh confirmation of your identity, and it is subject to the same 7-day waiting period as bank details. The accuracy of the address and the network is your responsibility — payments to a wrong address are lost irrevocably.
- The payout amount is calculated in USD and transferred one for one into the stablecoin; you bear the payment provider’s network and service fees, which are shown to you before you confirm.
- Crypto payouts run as a weekly batch and are subject to the same minimum amounts, fees and checks as bank transfers (sections 6 and 7), plus additional checks on the receiving address (the payment provider’s sanctions and risk screening, and the travel rule).
- We hold no cryptocurrency for you; once the payment is handed to the network, the payout is complete. The tax consequences of being paid in cryptocurrency are your own responsibility.
5.3 Further methods (planned)
Copy link to “5.3 Further methods (planned)”The following are planned for later phases, with no binding entitlement: further payment service providers for countries outside the SEPA area, USD and GBP transfers, and a second crypto provider for EU customers. Minimum amounts and fees may differ by method and will be published before they are introduced.
5.4 Confirming a payout where the bank details are new
Copy link to “5.4 Confirming a payout where the bank details are new”Protection against misuse of bank details rests on the 7-day waiting period with an email notification (section 5.1) and — where something looks irregular, or as part of enhanced due diligence (section 7.4) — on producing a bank statement showing that the account is yours. Where the account holder’s name differs from your verified name, we pay out only once the matter is clear.
Discrepancies in payouts (amounts missing or wrong) please tell us within 30 days of the payout date, at billing@desioart.com, so that we can trace them with our payment service provider; we look into later reports as well, but may by then be unable to reconstruct the payment route completely (section 11).
6 Balances, minimum amounts and payout fees
Copy link to “6 Balances, minimum amounts and payout fees”6.1 Your balance account
Copy link to “6.1 Your balance account”Your remuneration is held in a balance account in our accounting system (in USD, to the cent; every entry is logged immutably and visible to you in your statement of account). That balance is a contractual claim against us — not trust property, not client money, not e-money and not a deposit. It bears no interest and cannot be transferred to anyone else or used to pay for anything on the platform. Mandatory protective provisions of your own country are unaffected.
Payouts become possible once your available balance reaches these minimums:
| Minimum payout | Payout fee |
|---|---|
| USD 20 to under USD 50 | 15 % of the amount paid out |
| from USD 50 | free |
In addition: at most one payout a week (rolling, 7 days since the last one). The fee on small payouts is shown transparently before you confirm and is rounded down to whole cents. For referral commission earned by users without a creator account the minimum is USD 100, with no fee scale.
Payout requests below the threshold are refused by the system. Amounts below it stay in the balance account and keep accumulating; when your account closes, Creator Terms section 12.1 applies.
6.2 Entitlement to payouts: the KYC gate and a minimum of content
Copy link to “6.2 Entitlement to payouts: the KYC gate and a minimum of content”You become entitled to payouts once both are met: (1) a successful stage 2 identity verification (below) and (2) at least 5 published items of media on your profile (protection against empty accounts and money laundering; whether your profile can be subscribed to is a separate matter). Where something looks irregular, the compliance team may ask for more information before releasing a payout (section 7).
Before your very first payout the stage 2 identity check is triggered automatically (see Age Verification section 4.2 and Creator Terms section 2.1). Note that for creators stage 2 is triggered at the first adult upload anyway — in which case a payout is possible as soon as the minimum amount is reached.
Once stage 2 verification succeeds, payouts are unlocked automatically, with no manual platform review needed, unless one of the EDD triggers in section 7 applies. Without a tax identification number on file (and a W-9 or W-8BEN where needed) no payout is possible (section 9).
6.3 How often payouts happen, and how they are processed
Copy link to “6.3 How often payouts happen, and how they are processed”Payouts are made manually, on request through the creator dashboard with a fresh confirmation of your identity — at most one a week (section 6.1). We do not offer automatic payouts at present.
We aim to hand approved payouts to the payment provider within 5 working days; when the money reaches your account after that depends on your bank or on the network. Delays can arise from fraud or content reviews under way, from banks’ and providers’ own processing times, and from wrong payment details. Payout requests above USD 1,000 are additionally inspected briefly by the compliance team (within 72 hours at most).
6.4 Dormant balances
Copy link to “6.4 Dormant balances”An available balance you do not draw down for twelve (12) months, during which your account shows no activity, counts as dormant. The process:
- We remind you by email and in your account after nine and after eleven months without activity, and send a final warning once the twelve months are up, expressly naming the date, the procedure and the consequence.
- If you request no payout and do not sign in within the further 30 days after that final warning, the dormant balance lapses in our favour and we close the balance account.
- If you come back later with a reason we can follow, we may at our discretion release and pay the balance again after fresh KYC and tax checks — up to six years after it arose; there is no entitlement to it once the further period has passed.
- If you are resident in the USA, mandatory rules on unclaimed property apply (the states’ unclaimed property and escheat laws): instead of the balance lapsing, we report and transfer it to the competent authority once the relevant state period expires, and you can reclaim it there. The same applies where the law of your country mandates comparable procedures.
Limitation, insolvency and consumer protection rules that are mandatory in your favour are unaffected.
7 Anti-money-laundering (AML) and enhanced due diligence
Copy link to “7 Anti-money-laundering (AML) and enhanced due diligence”7.1 The legal basis
Copy link to “7.1 The legal basis”We shape our anti-money-laundering work around the EU anti-money-laundering directives, the EU Anti-Money Laundering Regulation (EU) 2024/1624 and the Cyprus Prevention and Suppression of Money Laundering Activities Law of 2007 (as amended), working with our payment service providers, who carry out checks of their own as obliged entities. Suspicion of money laundering, terrorist financing or sanctions breaches we report to the competent body (the Cyprus Financial Intelligence Unit, MOKAS). Our compliance office is responsible for anti-money-laundering (compliance@desioart.com), and our team is trained regularly.
7.2 Standard due diligence (CDD)
Copy link to “7.2 Standard due diligence (CDD)”For every creator we carry out standard customer due diligence:
- the stage 2 identity check
- proof of a tax ID
- proof of bank details (an account in your own name)
- continuous transaction monitoring
7.3 Enhanced due diligence (EDD) — the triggers
Copy link to “7.3 Enhanced due diligence (EDD) — the triggers”Enhanced due diligence is triggered by any of the following:
- monthly gross revenue above EUR 10,000 (in the USD equivalent)
- a single payout request above EUR 5,000 (in the USD equivalent)
- a hit on a sanctions or PEP (politically exposed persons) list
- unusual transaction patterns (see section 7.7)
- geographic risk indicators (payouts to high-risk countries; crypto addresses carrying a risk rating)
- a request to lift a fan’s spending cap (Terms section 5.5), so far as it concerns your earnings
7.4 What enhanced due diligence requires
Copy link to “7.4 What enhanced due diligence requires”Where EDD is triggered we may additionally ask for:
- proof of the source of funds (bank statements, a tax assessment, documentation of your business activity)
- extended identity verification (a further video call, a second identity document)
- confirmation from a bank statement that the account is yours
- fuller explanation of your business background, particularly where several people or an agency are involved
7.5 What follows from enhanced due diligence
Copy link to “7.5 What follows from enhanced due diligence”- payouts are paused until the EDD review is complete (30 working days at most)
- where AML compliance is confirmed: the payout is released and standard due diligence continues at a raised monitoring level
- where the suspicion is not dispelled: the account is suspended, a report goes to the FIU and, where necessary, payouts are retained until the authorities resolve it; the law forbids us to tell you about an FIU report
7.6 Sanctions list screening
Copy link to “7.6 Sanctions list screening”We carry out continuous (weekly) sanctions list screening (the EU Consolidated List, OFAC SDN, the UK HMT/OFSI Consolidated List) through our verification provider. Where your name, your bank account or your wallet address matches one of those lists, payouts are blocked at once and the account is reviewed; we pass on no payments from or to sanctioned regions (Terms section 2.3).
7.7 Warning signs, and protections on the fan side
Copy link to “7.7 Warning signs, and protections on the fan side”Among the patterns we examine automatically and through trained staff are: several payment cards in different names on one fan account; conspicuously rapid series of purchases; payments from risky IP addresses; identical IP or device characteristics for a fan and a creator; newly created fan accounts spending heavily; buy-and-lower patterns (section 4.4); messages demanding money back through outside channels (“return 50 % to me via …”); and turnover that does not fit your profile so far. On the fan side, spending limits (Terms section 5.5), minimum and maximum prices, velocity limits and card-testing detection all do their part. We can suspend a suspicious transaction until the matter is clear; confirmed abuse we report to the authorities and those involved are excluded.
8 Earnings statements and reports
Copy link to “8 Earnings statements and reports”8.1 The live dashboard (available at any time)
Copy link to “8.1 The live dashboard (available at any time)”The creator dashboard shows you, live and at any time:
- your current pending balance (per tranche, with its expiry date), available balance and lifetime earnings
- gross revenue per revenue stream (subscription, tip, pay-per-view post, pay-per-view message, media link, custom request, referral)
- the platform commission and the fee policy version applied, per transaction
- the VAT per transaction, broken down by country
- the hold period status of every outstanding item of revenue
- chargebacks, refunds and set-offs in chronological order, with reasons
- your chargeback rate (30 days, as a traffic light), your payout history with the fees, and a payout forecast
You can download an export (PDF or CSV) of your current statement at any time; exports contain fan identifiers only so far as you may use them under Creator Terms section 10.7.
8.2 The annual statement (early January)
Copy link to “8.2 The annual statement (early January)”At the start of each January we make a consolidated annual earnings statement available to you for the tax year just ended:
- total gross revenue
- total platform commission
- total VAT, by country
- total chargebacks and refunds
- total net payouts (bank and crypto shown separately)
- a breakdown by revenue stream
- the annual self-billed invoice under section 2.4
You receive an email as soon as the annual statement is available in the dashboard. On request we provide monthly or quarterly statements too.
9 Tax reporting by the platform
Copy link to “9 Tax reporting by the platform”9.1 DAC7 — the EU reporting obligation
Copy link to “9.1 DAC7 — the EU reporting obligation”As a Cypriot limited company, DAAR GLOBAL LIMITED reports the following about creators resident in the EU to the Cypriot tax administration each year under EU Directive 2021/514 (DAC7), by 31 January for the previous year:
- identity and address data (KYC)
- the tax identification number (and the VAT ID, where there is one)
- remuneration, broken down by quarter
- the number of transactions, and the fees and commission retained
- bank details (the account holder and the IBAN)
The threshold: a creator is reported from 30 transactions a year OR EUR 2,000 of remuneration a year. The threshold is set in euro by law, and we convert USD amounts for it. Linked accounts are added together.
The Cypriot tax administration passes the data to the tax authority of your home country.
You receive a copy of your DAC7 report in early February, to use with your own tax return. Where tax data is missing or implausible we must ask you for it before reporting; payouts can be suspended until the matter is clear.
9.2 US 1099-NEC — the US reporting obligation
Copy link to “9.2 US 1099-NEC — the US reporting obligation”For creators resident in the USA we issue a Form 1099-NEC once the reporting threshold of USD 2,000 per tax year is reached, and report it to the IRS and to you (by email and as a download in the dashboard) by 31 January of the following year at the latest.
This requires that you completed a Form W-9 (for US persons) or a Form W-8BEN (for non-US persons with a US connection) in full during onboarding. Without a valid W-9 or W-8, US law allows us to apply backup withholding of 24 %.
9.3 UK — notes on self-assessment
Copy link to “9.3 UK — notes on self-assessment”For creators resident in the UK we do not report to HMRC automatically; the UK reporting obligations for platforms (the OECD model rules) apply to us as an EU platform through DAC7. We nonetheless strongly recommend:
- from £1,000 of annual platform income (the trading allowance), self-assessment with HMRC is required
- registering as a sole trader or a limited company, where appropriate
- registering for UK VAT where the UK VAT registration threshold in force is exceeded; for VAT purposes what you supply to us lies in Cyprus (section 2.4)
9.4 Other jurisdictions
Copy link to “9.4 Other jurisdictions”Creators in other countries may face national reporting obligations — we provide the annual statement for you to use in your own tax return. Checking and meeting your local tax obligations is your responsibility. We give no tax advice and are not liable for your tax obligations.
9.5 Internal platform reporting
Copy link to “9.5 Internal platform reporting”We keep an internal tax reporting dashboard holding all reportable data. It is accessible only to our tax and compliance staff (role-based rights, two-factor authentication, logged access) and is subject to strict GDPR compliance.
10 What closing or suspending an account does to payouts
Copy link to “10 What closing or suspending an account does to payouts”10.1 Ordinary termination (by you or by us)
Copy link to “10.1 Ordinary termination (by you or by us)”On ordinary termination:
- the pending balance moves to the available balance once the hold period expires
- the available balance is paid out in full (the standard minimums and fees apply; a remainder below the minimum is paid on request, less the fee)
- the final payout happens within 30 working days of the hold ending at the latest
- a negative balance (section 4.6) falls due at once
10.2 Immediate suspension for an AUP breach or a compliance problem
Copy link to “10.2 Immediate suspension for an AUP breach or a compliance problem”With every immediate suspension, outstanding payouts are frozen at first. What then happens to your balance is graded by seriousness, on this principle: amounts connected with the breach are retained specifically, and the remainder, where nothing is complained of, is paid out. There is no blanket forfeiture. Every retention is reviewed under the four-eyes principle and notified to you with reasons.
(a) Amounts connected with the breach — always retained:
- revenue arising directly from the content or conduct complained of,
- amounts from chargebacks, refunds and fraud,
- on a permanent ban, the pro-rata refund to fans for subscriptions so far as it falls on the content complained of (the rest of the unused subscription we bear ourselves, section 4.5).
These are retained and, where fans lost out, refunded to them. Where such amounts have already been paid out they constitute a debt, which we set off against future balance or reclaim (Terms section 5.7).
(b) The remaining balance, where nothing is complained of:
- for breaches of moderate seriousness (repeated or escalated breaches under Acceptable Use section 9): the available balance is paid out after an extended protection period of 30 days, covering the chargeback window, and the pending balance once the hold ends — in each case less any outstanding claims under (a) and, for amounts under USD 50, the fee under section 6.1 (15 %) for the work of closing the account;
- for serious breaches (Acceptable Use section 2 zero tolerance, money laundering, a sanctions hit, trafficking): the whole balance is retained until the matter is clear; where a criminal matter is involved, proceeds of unlawful acts are not paid out and may be confiscated by the authorities. Where the matter is resolved without the serious breach being confirmed, we settle as under (b) for moderate seriousness.
(c) Dormant balances: see section 6.4.
10.3 Appeals
Copy link to “10.3 Appeals”Against every retention of a payout, every extended hold period and every set-off you have the right to appeal under Appeals — for at least six months from the notice (Article 20 DSA; Article 4 P2B). The review is carried out by someone who had no part in the decision, and if your appeal succeeds we release the retained balance without delay. Complaints about our conduct go through Complaints; the certified out-of-court dispute settlement bodies under Article 21 DSA are open to you as well.
11 Disputes about earnings
Copy link to “11 Disputes about earnings”Where your balance and what the statement shows do not agree, or a payout fails to arrive or is wrong:
- Report it within 30 days of the transaction concerned if you can, through “Report a payment problem” in the dashboard or to billing@desioart.com with the subject “Earnings discrepancy” and a detailed description — the sooner you tell us, the more completely we can reconstruct the transaction with the payment provider. Reporting later does not extinguish your claims.
- We look into it within 14 working days and answer with a detailed breakdown.
- If you still disagree, you can complain under Complaints and appeal under Appeals.
We are not answerable for losses caused by wrong or outdated payout details that you entered.
12 Updates to this policy
Copy link to “12 Updates to this policy”Where a change is substantial (to the commission model, the fee policy, the hold period, the AML thresholds or the payout methods) we tell you at least 30 days beforehand by email and in the creator dashboard, and for other changes at least 15 days beforehand (Article 3(2) of Regulation (EU) 2019/1150); a shorter period applies only where the law obliges us or an immediate danger must be averted. Changes never apply retrospectively to transactions already settled (section 2.2). Within the notice period you can end your creator relationship with immediate effect; for substantial changes we ask you to confirm expressly at your next sign-in (Terms section 14).
The current version and a record of the changes are at legal.desioart.com.
