Non-Consensual Intimate Imagery Takedown Policy
Preamble and our commitment
Copy link to “Preamble and our commitment”This policy governs our procedure for taking down, as fast as we possibly can, intimate recordings made or distributed without the consent of the person depicted (“NCII” — non-consensual intimate imagery, often called “revenge porn”, although it is never about revenge but about violence), digital fakes (deepfakes) included.
NCII is a serious form of digital sexual violence. We regard fighting it as a core duty of an adult content platform, not merely a legal one. This policy establishes a 24-hour procedure with immediate provisional blocking, protection of the person affected against being put through it again, and lasting protection against re-uploading.
It implements:
- Articles 16, 17 and 18 DSA (notice and action, statement of reasons, reporting criminal offences)
- the US TAKE IT DOWN Act (Public Law 119-12): removal within 48 hours of a valid request, identical copies included, and reasonable efforts against re-uploading — we apply it regardless of whether it binds us, and we beat the deadline
- section 184k StGB, section 201a StGB, sections 22, 23 and 33 KunstUrhG and the general right of personality (Germany), together with the corresponding criminal and civil provisions of Cyprus and of the countries the people affected live in
It forms part of our terms of service (Terms section 19.1) and supplements Acceptable Use section 2.2 (the prohibition), Co-Performers (consent), Moderation (procedure), DMCA (copyright) and Anti-Slavery (coercion).
1 What counts as non-consensual intimate imagery?
Copy link to “1 What counts as non-consensual intimate imagery?”Any recording (a photo, a video, audio with an identifiable voice, a livestream capture) showing a real, identifiable person in an intimate or sexual context without that person having validly consented to the recording and to its publication — or where they have withdrawn their consent. That includes:
- recordings shared privately and then passed on without agreement
- covert recordings (voyeurism, upskirting, hidden cameras)
- recordings stolen from accounts, cloud storage or devices
- digital fakes: intimate depictions of a real person created or altered with software or AI that a sensible person might take for real — the output of “nudify” tools included; whether it can be spotted as a fake makes no difference
- recordings made under coercion, pressure, deception or blackmail
- recordings whose publication the person depicted has withdrawn consent to — even where they originally consented as a co-performer or a creator
- commercially produced creator content uploaded by someone else without the consent of the person depicted (“leaks”) — this procedure applies for the person depicted, and DMCA applies in addition for the rights holder
Not NCII: content the person depicted published themselves, or has demonstrably and validly consented to (a documented consent under Co-Performers) — for as long as they do not withdraw it.
Where a recording shows a minor, it is not an NCII case but a case of child sexual abuse material: the child protection route applies (Moderation sections 2.1 and 6.4), with a report to NCMEC, and the person affected can additionally use NCMEC “Take It Down” (desioart.com/ncmec-takeitdown).
2 What we commit to
Copy link to “2 What we commit to”We commit ourselves:
- to acknowledge every report at once and, where a report is plausible, to block the content reported provisionally without delay and within 24 hours at the latest — cases of active distribution or blackmail immediately
- to remove identical and substantially identical copies on the platform as well, and to prevent re-uploading through hash blocks
- to believe the person depicted until the contrary is shown — to demand no evidence that puts them through it again (no identity document at first contact, no criminal complaint as a precondition, no explanation of why they did not consent)
- never to pass the reporting person’s identity to the person reported
- to preserve evidence where a criminal offence is suspected and — with regard for the wishes of the person affected, wherever the law allows — to work with the authorities
- to decide the case finally within 7 days and to tell the person affected
3 Prevention: consent and hash matching
Copy link to “3 Prevention: consent and hash matching”3.1 Consent before publication
Copy link to “3.1 Consent before publication”No content with another person in it can be published before that person is verified and has consented (Age Verification section 8, Co-Performers). If they withdraw, the content is hidden at once. A withdrawal connected with an NCII, coercion or minor report cannot be undone by the creator or by a fresh “consent” (a safety hold) — it is lifted only after we have looked into it.
3.2 StopNCII
Copy link to “3.2 StopNCII”We use the international hash procedure of StopNCII.org — a free, non-profit service for people affected, which many platforms are connected to; the matching is live as soon as our connection is approved (Moderation section 2.1). People affected who are 18 or over generate a hash of their intimate recordings on their own device — the image never leaves it — and partner platforms then block uploads with a matching hash. With us, a match is blocked automatically and the uploading account is examined. How it works: https://stopncii.org/ → “Create your case” → generate hashes → protection across every partner.
The limits of StopNCII: private recordings of people aged 18 or over only (deepfakes included); not commercially produced content (for which our own hash block after a report applies, section 5.4, together with DMCA); for minors, NCMEC “Take It Down”.
3.3 Our own hash blocks
Copy link to “3.3 Our own hash blocks”Every item we remove as NCII goes into our block list as a perceptual hash (of the image and of video frames); uploading it again, even slightly altered, is refused (Moderation section 2.1). At the request of the person depicted we also pass the hash to StopNCII, within 72 hours, so that other platforms protect them too.
3.4 Child sexual abuse material
Copy link to “3.4 Child sexual abuse material”For known child sexual abuse material we run a hash match against the recognised reference databases on every upload (Privacy section 2.10). Matches are reported to NCMEC without any discretion and pursued criminally.
3.5 Data protection in hash matching
Copy link to “3.5 Data protection in hash matching”Images are never shared between platforms, only hashes; content we have removed we keep encrypted, as evidence and nothing else (section 5.3).
4 Reporting
Copy link to “4 Reporting”4.1 Who can report?
Copy link to “4.1 Who can report?”- the person depicted — with or without an account, with or without proof of identity
- a representative of the person depicted (a lawyer, a relative, a support service; for minors a parent or guardian — and then the child protection route)
- specialist bodies and trusted flaggers (Moderation section 5)
- anyone else with a concrete suspicion — anonymously if they wish
4.2 How to report
Copy link to “4.2 How to report”| Channel | Notes |
|---|---|
| desioart.com/nci-takedown | recommended — no account needed; three short questions send you down the right route (minors → child protection; copyright only → DMCA; otherwise the NCII form); no legal name required; an email address is optional; with a security check |
| ncii@desioart.com | subject “NCII — [link]”; an automatic acknowledgement follows at once |
| the “Report” icon on the content | the “non-consensual intimate content” category — anonymously too; the content and its context are attached automatically |
| By post | 1 Apriliou 52, 7600 Athienou, Larnaca, Cyprus, marked “NCII” — for anyone who would rather avoid online channels |
4.3 What we need to know
Copy link to “4.3 What we need to know”Required: the link or identifier of the content (or a screenshot showing where it is) and confirmation that the person depicted did not consent, or is withdrawing their consent; where you act for someone else, your relationship to the person depicted.
Helpful, but voluntary: a way to reach you with questions and with the outcome; whether further copies exist; whether blackmail is involved; and a power of attorney where you act for someone else.
What we do not require: an identity document at first contact; an explanation of why consent is absent; a criminal complaint; signed forms. Confirming your identity may become necessary later if the uploader produces a documented consent (section 5.4) — and then as gently as possible.
4.4 Anonymous reports
Copy link to “4.4 Anonymous reports”We examine completely anonymous reports just as carefully; without a way to reach you we cannot tell you the outcome. In the NCII form you receive an email confirmation only if you expressly want one, in case someone else reads your mail.
5 Our 24-hour procedure
Copy link to “5 Our 24-hour procedure”5.1 Receipt — at once
Copy link to “5.1 Receipt — at once”An automatic acknowledgement with a case number, where you gave us a way to reach you. Someone from our team is normally in touch within 2 hours during the day, and within 24 hours at the latest.
5.2 Provisional blocking — without delay, within 24 hours at the latest
Copy link to “5.2 Provisional blocking — without delay, within 24 hours at the latest”On every plausible report (the content can be found, and the report is not plainly abusive) we hide the content and identical copies at once, without waiting for the review. Where distribution is under way, where there is blackmail, or where the person is in danger, we act within minutes. The uploading account is restricted provisionally from uploading and messaging.
5.3 Preservation of evidence — before the block
Copy link to “5.3 Preservation of evidence — before the block”We preserve the content and the associated data (upload time, account data, hashed connection data, verification status, evidence of consent) encrypted and immutably for 5 years; access only with four-eyes approval and a logged purpose (Moderation section 9.2). Disclosure only to law enforcement on a lawful order or, at the request of the person affected, to support their complaint (section 6.2).
5.4 Decision — within 7 days
Copy link to “5.4 Decision — within 7 days”- Confirmed: the content and its copies are removed for good; the hash goes into our block list and, on request, to StopNCII; the uploading account is permanently banned (Acceptable Use section 2.2 — zero tolerance, with four eyes); the revenue connected with the breach is retained; a report goes to the authorities under section 6; the warning never expires.
- Not confirmed: the content is restored, the uploader faces no consequence, and the reporting person is told, with reasons and a right to appeal.
- Consent in dispute: where a documented consent exists that the person depicted disputes or withdraws, the content stays hidden; we offer clarification by a neutral body at our cost (Appeals section 7.2). A withdrawal always takes effect for the future — the content stays offline; what can be in dispute is only whether the creator suffers any detriment from the withdrawal.
- We need to ask: we get in touch, and the content stays hidden. If the reporting person does not answer within 14 days, the content stays hidden where doubts about consent remain; otherwise we restore it and say so.
5.5 Support for the person affected
Copy link to “5.5 Support for the person affected”In every case we offer the person depicted:
- to secure, pause or close their account (if they have one) and to limit their visibility
- help with StopNCII (section 3.2) and, for minors, with NCMEC “Take It Down”
- confirmation of the case for a criminal complaint, a lawyer or other platforms
- contacts for support services: HateAid (Germany, hateaid.org), the helpline for violence against women, 116 016 (Germany), Weisser Ring 116 006 (Germany), bff — Frauen gegen Gewalt (Germany, frauen-gegen-gewalt.de), the Revenge Porn Helpline (UK, revengepornhelpline.org.uk), the Cyber Civil Rights Initiative (USA, cybercivilrights.org), StopNCII.org and SPAVO 1440 (Cyprus, domviolence.org.cy)
- an introduction to initial legal advice (we do not give legal advice ourselves)
6 Working with law enforcement
Copy link to “6 Working with law enforcement”6.1 What we report ourselves
Copy link to “6.1 What we report ourselves”- Child sexual abuse material: always and without delay — NCMEC, the Cyprus Police and, where Germany is involved, the Bundeskriminalamt (Moderation section 6.4)
- Sextortion, blackmail, threats to life or safety: a report to the competent police under Article 18 DSA — wherever possible in agreement with the person affected, and without their agreement only where there is immediate danger
- Coercion, exploitation, trafficking: Anti-Slavery
- Other NCII cases: we do not report against the wishes of the person affected (section 184k StGB requires a complaint by the victim), but we preserve the evidence so that they can decide for themselves.
6.2 At the request of the person affected
Copy link to “6.2 At the request of the person affected”With the agreement of the person depicted we give them a case confirmation (the upload time, the account identifier, the measures taken) for a criminal complaint or civil proceedings. The uploader’s identity data (their verified name) we disclose only on a lawful order (section 100j StPO or its equivalent; Moderation section 6.2) — and we help the person affected reach the right body.
6.3 Requests from authorities
Copy link to “6.3 Requests from authorities”Requests reach us at legal@desioart.com (subject “Law Enforcement Request”); the contacts for authorities are in Moderation section 6.5.
7 Protection against misuse of this procedure
Copy link to “7 Protection against misuse of this procedure”7.1 Reports that are disproved
Copy link to “7.1 Reports that are disproved”Where a report turns out to be unfounded (section 5.4), the content is restored and the uploader faces no penalty. Anyone who knowingly misuses the NCII procedure breaches Acceptable Use section 10.6; account holders face anything from a warning to a ban, and people without an account we can bar. In this procedure we are deliberately generous towards those who report: the harm of a removal that comes too late weighs more than that of a temporary hiding.
7.2 Protecting those who report
Copy link to “7.2 Protecting those who report”We never pass a reporting person’s identity or contact details to the uploader; the reasons given to the uploader name only the category and the content concerned. Nobody who reports is put at a disadvantage.
7.3 The uploader’s rights
Copy link to “7.3 The uploader’s rights”The uploader receives a statement of reasons (Article 17 DSA) and can appeal (Appeals); the appeal is decided by someone else, and the content stays hidden until then. Permanent bans are subject to the four-eyes principle.
8 Withdrawing consent you gave earlier
Copy link to “8 Withdrawing consent you gave earlier”If you consented to an item of content — as a co-performer, or as a creator towards another creator — and no longer want to, you can withdraw at any time:
- with an account: under Appearances (“co-creator”) → withdraw consent; the content is hidden at once and the creator is told
- without an account: at desioart.com/nci-takedown or ncii@desioart.com
The withdrawal takes effect for the future, and the creator must remove the content or obscure you. What a withdrawal means contractually between you and the creator is governed by Co-Performers — your decision not to be shown any more we respect in every case.

10 Transparency
Copy link to “10 Transparency”The number of reports, confirmed cases, the average handling time, transmissions to StopNCII and reports to authorities we publish annually in the transparency report (Moderation section 9.3) — with no identifying data about those affected or about uploaders.
11 Updates
Copy link to “11 Updates”Where a change is substantial we tell you 30 days beforehand (creators at least 15 days, Article 3 of Regulation (EU) 2019/1150). We review this policy every six months (the TAKE IT DOWN Act, the EU directive on combating violence against women (EU) 2024/1385 — to be implemented by 14 June 2027, section 184k StGB).
