Creator Referral Terms
Preamble
Copy link to “Preamble”These terms govern our referral programme, under which users bring new creators to desioart and receive commission for it out of our share of the referred creator’s revenue. They give substance to Terms section 10, Creator Terms section 6.5 and Creator Earnings section 2.6, and prevail over them for the referral programme.
The programme has one level: there is no commission for referring referrers, no commission for referring fans, and no fee to take part. It is not a distribution scheme within the meaning of section 16(2) UWG or comparable provisions; earnings arise solely from what the referred creator actually takes from fans.
1 Terms used
Copy link to “1 Terms used”| Term | Meaning |
|---|---|
| Referrer | a user (fan or creator) with an active account who shares their personal referral link |
| Referred creator | someone who registers an account for the first time through the referrer’s link and becomes a creator |
| Referral link / code | the referrer’s personal link desioart.com/r/[code], or their code |
| Commission base | fans’ payments to the referred creator (subscriptions, pay-per-view, tips, custom requests, media links) less VAT and before our platform commission is deducted |
| Unlocking | the moment commission starts to arise: the referred creator has earned EUR 100 in total and you meet the conditions in section 2.1 |
| Commission period | 12 months from the moment of unlocking |
2 Taking part
Copy link to “2 Taking part”2.1 Who may refer
Copy link to “2.1 Who may refer”Every user with an active, unsuspended account — fans and creators alike — can share their referral link. Commission starts to arise (unlocking, section 3) only once you have passed the identity check (stage 2, Age Verification section 4.2), at least 30 days have passed since then, your account is not permanently banned and no serious warnings are outstanding against you. Payouts additionally require what section 5 sets out.
2.2 Who can be referred
Copy link to “2.2 Who can be referred”People who have no account with desioart yet, create one through your link and become creators. Commission does not arise for:
- you yourself, your linked accounts (Creator Terms section 2.5) and anyone whose account you control or run
- further accounts of the same referred creator: commission arises only from the account they registered first, not from ones created or linked later
- people you are connected with in business in a way that amounts to referring yourself: an agency and its creators, an employer and employee, holders of the same bank details
- people who already had an account, including deleted and banned ones; where someone clicks several referral links, the link used last before registration counts (section 2.3)
- accounts operated by the company (AI personas, Community section 2.5)
- accounts that breach our rules and are banned for it
Where someone registers through your link as a fan at first and becomes a creator only later, the attribution holds; commission then arises from the moment they meet the conditions in section 3 as a creator. For fan accounts that never become creator accounts there is no payment.
We may ask for proof that the referrer and the person referred are independent of one another.
2.3 Attribution
Copy link to “2.3 Attribution”Attribution happens when the person referred clicks your link and registers. Where they click the link and register only later, we remember the click only if they agreed to the marketing category in the cookie banner at the time of clicking — in which case we hold it server-side under a pseudonymous visitor identifier for 30 days (Cookies section 2.3), and the link used last within that period counts. Where they decline, or change browser or device, we cannot see the referral and pay no commission — so please tell the people you refer to use the link immediately before registering. Attribution after the event, without that data, is impossible.
2.4 What the person referred is told
Copy link to “2.4 What the person referred is told”On registering, the referred creator is told that an attribution to a referral link exists and that the commission is paid out of our share — it does not reduce their remuneration. We do not show them who referred them.
3 The commission
Copy link to “3 The commission”| Parameter | Value |
|---|---|
| Rate | 5% of the commission base |
| Duration | 12 months from unlocking (section 1) |
| Cap | USD 50,000 per referred creator |
| Unlocking | commission arises from the moment the referred creator has earned EUR 100 in total (the USD equivalent at the day’s rate) and you meet the conditions in section 2.1; revenue before unlocking counts towards the threshold but triggers no commission |
| Source | our platform commission — nothing is charged to the referred creator |
| Costs | no further platform commission on referral commission; payout fees under Creator Earnings section 5 |
| Reversal | refunds, chargebacks, retentions and forfeitures affecting the referred creator reduce the commission pro rata; commission already paid out is set off against future commission (Creator Earnings section 2.5) |
| Currency | USD (Terms section 5.1) |
Commission from the programme is shown separately in your balance account as “referral” and is subject to a hold period of 21 days (chargeback protection), after which the general payout rules apply.
4 Rules for promoting your link
Copy link to “4 Rules for promoting your link”When you share your link:
- Be honest: say nothing about a creator earning a particular sum on desioart, or earning anything at all; invent no success stories; and disclose that it is a referral link wherever the context calls for it (Advertising).
- Not in our name: do not hold yourself out as desioart, and do not use our brand as an advertising keyword, a domain or a sender name (Terms section 8.5); no paid search advertising on our brand or our domains without our written agreement.
- No spam: no unsolicited bulk messages, no automated posting, no placing links in other people’s comment sections against their rules, no recruiting through dating apps or of minors.
- No recruiting under pressure: do not recruit people in relationships of dependency; promise the people you refer no payment for registering; do not pass part of your commission to them as a “discount”; and note that recruiting with promises of travel or accommodation is a warning sign of trafficking (Anti-Slavery section 5).
- Keep to the rules of the channels you use (social media policies, adult restrictions).
- On request you tell us how and where you share your link.
5 Payout, checks and tax
Copy link to “5 Payout, checks and tax”- Commission is credited to your balance account; paying it out requires a passed identity check (stage 2), payout details on file, tax details (tax ID, VAT status, a W-9 or W-8BEN where needed), a passed sanctions screening and — where something looks irregular — a money laundering and exploitation review (Creator Earnings section 7).
- Users without a creator account can have commission paid out from USD 100; for creators the general payout rules apply (Creator Earnings section 5).
- VAT: the commission is consideration for the intermediation you supply to us; it is accounted for by self-billing (Creator Earnings section 2.4), and under the reverse charge procedure for businesses elsewhere in the EU. Consumers and small businesses receive the commission without VAT. Paying tax on your commission is your responsibility.
- Reporting: commission is income, which we report under DAC7 (EU) and, where applicable, on a 1099-NEC (USA) (Creator Earnings section 9).
- Commission from the programme lapses under the inactivity rules (Creator Earnings section 6.4) and is dealt with under Creator Earnings section 10 when your account closes.
6 Abuse, withdrawal of commission, and appeals
Copy link to “6 Abuse, withdrawal of commission, and appeals”6.1 Checks
Copy link to “6.1 Checks”We examine referrals automatically and by hand for abuse — above all for referring yourself through linked identities, the same bank details, the same devices or connection data; for artificial turnover (fan accounts that buy only to generate commission); for card fraud; and for co-ordinated networks. A conspicuous pattern is a signal to look, never an automatic ground for a ban; a human being decides whether commission is withdrawn (Privacy sections 2.7 and 3.4).
6.2 Withdrawal of commission
Copy link to “6.2 Withdrawal of commission”Where you refer yourself, commit fraud, generate artificial turnover, or breach section 4 or the AUP, we withdraw the commission for the referrals concerned, set off amounts already paid, and may exclude you from the programme. Where the referred creator is permanently banned for serious breaches, the commission on their retained earnings falls away. Every withdrawal comes with reasons.
6.3 Appeals
Copy link to “6.3 Appeals”You can appeal against a withdrawal or an exclusion within 6 months (Appeals); if you succeed, the commission is paid after all.
7 Data protection
Copy link to “7 Data protection”For attribution we process your referral code, the time of the click and hashed connection data from it (30 days), the link between referrer and person referred (for as long as the programme runs and the retention periods last), and fraud signals (Privacy sections 2.7 and 7.1). Your overview shows you only the referred creator’s stage name or username and the commission arising from them — no revenue details and no fans. The referred creator sees that an attribution exists, but not to whom (section 2.4).
8 Changes to the programme, and ending it
Copy link to “8 Changes to the programme, and ending it”We can change the programme or discontinue it. Changes to the commission parameters we announce at least 30 days beforehand (creators at least 15 days, Article 3 of Regulation (EU) 2019/1150), and they apply only to referrals made after they take effect — commission periods already running continue on the old terms, with no retrospective change. If we discontinue the programme, commission periods already running are seen through to the end.
9 No affiliate programme between creators
Copy link to “9 No affiliate programme between creators”A programme in which creators promote other creators for a continuing share of revenue is something we do not offer at present; creators may recommend and link to one another (as co-creators, Co-Performers), and private agreements about sharing revenue are not something we administer (Creator Terms section 9.4).
