Co-Authored Content and Consent Policy
Preamble
Copy link to “Preamble”Content with several people in it is welcome on desioart — couples, groups, guest appearances, creators working together. This policy governs what applies when someone other than you is visible or audible in your content: who must be verified, how consent is given, documented and withdrawn, what rights those taking part have, and who answers for what. It gives substance to Creator Terms section 9.4 and prevails over it on questions of consent.
The principle: no content with another person in it is published before that person is of full age and verified and has consented themselves through our consent system — not the creator on their behalf, and not an agency on their behalf. A withdrawal is always respected.
1 Terms used
Copy link to “1 Terms used”| Term | Meaning |
|---|---|
| Person taking part | anyone other than the uploading creator who is recognisable in an item of content, visually or by sound — whether or not they have an account, and whether or not their face is visible |
| Co-creator | a person taking part who has a creator account of their own |
| Co-performer | a person taking part without a creator account; they receive a slim co-performer account through an invitation link (Terms section 2.8) |
| Uninvolved person | someone who appears incidentally in the background and is not what the recording is about |
| Consent (release) | a person’s informed agreement, documented through our system, to the recording and publication of a particular item of content or — as general consent — of a creator’s future content |
| Content level | suitable for all audiences (SFW) or not (NSFW); it determines the level of verification |
2 When this policy applies
Copy link to “2 When this policy applies”To every item of content in which someone takes part — posts, the media library, media links, broadcasts, message attachments, intro videos, promotional covers — whether the content is free or paid for. It applies to content made before your time on desioart as well: before it is published here, everyone taking part must be verified and must have consented.
3 Verifying the person taking part (following Age Verification section 8)
Copy link to “3 Verifying the person taking part (following Age Verification section 8)”| Content level | Verification | Who checks |
|---|---|---|
| suitable for all audiences | age verification (stage 1) | the verification provider — we receive only the result |
| not suitable for all audiences | identity check (stage 2) with an identity document, liveness and sanctions screening | the verification provider — records under 2257 Statement |
Co-creators usually hold the right level already; co-performers go through it via the invitation link. We check the level again with every consent; where a verification expires, no new consent can be given until it is renewed. Minors can never take part — not clothed, and not with their parents’ agreement either (Acceptable Use section 2.1).
4 Consent
Copy link to “4 Consent”4.1 How it works
Copy link to “4.1 How it works”- Declaration: on upload you state for every file who appears in it: only you, named co-creators or co-performers, or uninvolved people. A count of people, carried out on your own device (no facial recognition, no transmission of facial data) warns you when more people are visible than you declared; we store only the number.
- Invitation: people without an account you invite by email or link. The link is valid for 48 hours and can be used once; the person creates a co-performer account, verifies themselves and sees before consenting which creator and which content (a preview) it concerns.
- Consent: the person confirms their informed agreement through the platform (section 4.2). Consenting quickly is possible, and the full text can be read at any time.
- Release: only once everyone declared has consented is the content published; until then it stays a locked draft. For videos we store the time windows in which each person is visible (the 2257 record).
- Evidence: every consent is stored immutably with the time, the version of the text, the account, a hashed IP and a device identifier, and it remains as evidence even after the content is deleted (2257 Statement section 4, Privacy section 7.1).
4.2 What the consent covers
Copy link to “4.2 What the consent covers”The person taking part declares:
- that they are of full age and took part in the recording voluntarily, free of pressure, deception or intoxication;
- that they agree to the publication of the particular item (or of future content, section 4.3) on desioart by the named creator — including its use in previews, in the creator’s promotion on the platform, and in the forms of exploitation set out in Creator Terms section 5;
- that they consent to the processing of their verification data for the record-keeping obligations (18 U.S.C. § 2257) and of their data concerning their sex life (Article 9(2)(a) GDPR);
- that they know they can withdraw for the future at any time (section 5), and how;
- that the consent also covers the creator’s announcements on third-party platforms, so far as nothing appears there but excerpts suitable for all audiences or a neutral teaser card with a link (cross-posting, Creator Terms section 9.8).
The consent does not cover: passing the content to third parties, selling it away from the platform, use by other creators, AI training, or AI alteration of their person — each of those would need separate agreement.
4.3 General consent
Copy link to “4.3 General consent”A person taking part can give a creator general consent for future content at one content level. It is voluntary and opt-in, applies per creator and per level, is checked against valid verification each time it is used, and the person is notified of every publication relying on it and can withdraw any one of them, or end the general consent altogether. For content not suitable for all audiences, it is given in a separate step with its own explanatory text.
4.4 Nobody consents on someone else’s behalf
Copy link to “4.4 Nobody consents on someone else’s behalf”Agencies, managers, partners and creators cannot consent for a person taking part. Consents that plainly did not come from the person themselves (the same device or session as the creator, one immediately after the other; the same email address) we examine and may reject. A consent “sold” to the creator for payment, or given under pressure, is invalid; please report any sign of that to trafficking@desioart.com (Anti-Slavery).
5 Withdrawal, and the rights of people taking part
Copy link to “5 Withdrawal, and the rights of people taking part”5.1 Withdrawal
Copy link to “5.1 Withdrawal”Anyone taking part can withdraw their consent for the future at any time — under Appearances in their account (in a co-performer account too), or without an account at desioart.com/nci-takedown or ncii@desioart.com. The consequences:
- The content concerned is hidden at once; fans who bought it lose access (Terms section 8.4); the creator is notified and must delete the content or obscure the person (section 6) — until then it stays offline.
- The creator has no claim against us for the earnings they lose; earnings already made remain theirs, provided the consent was valid up to the withdrawal.
- Only the person themselves can release it again. Where the withdrawal is connected with a report of coercion, of a minor or of non-consensual recording, release again is blocked until we have looked into it (a safety hold).
- The evidence of the original consent, and the withdrawal, stay in the records (2257 Statement section 6).
As between the person and the creator: whether a withdrawal without good reason gives the creator a claim against the person taking part is a matter between them; towards the platform the withdrawal always stands, and we tolerate no pressure on anyone to take a withdrawal back.
5.2 Other rights
Copy link to “5.2 Other rights”People taking part can see at any time which content they are marked in and which consents exist; they are notified when something new is used under a general consent; they can contact us directly and without the creator knowing (records-custodian@desioart.com, ncii@desioart.com); and their data protection rights (Privacy sections 9 and 15.1) apply without qualification, save that records under § 2257 and preserved evidence are subject to the statutory periods. Where someone disputes that their consent was valid, NCII Takedown section 5.4 and Appeals section 7.2 apply (neutral clarification at our cost).
6 Uninvolved people and obscuring them
Copy link to “6 Uninvolved people and obscuring them”People who appear only incidentally in the background of recordings suitable for all audiences you can, instead of obtaining consent, irreversibly obscure with our redaction tool (a full covering). In doing so you confirm that the person is no longer recognisable afterwards — not even to people who know them — and you answer for that being correct. The original is kept locked for evidential purposes and is no longer delivered. Obscuring is not permissible for content not suitable for all audiences, for people who are what the recording is about, or for anyone involved in the action in any way; consent is always needed there. Recordings in places where uninvolved people have no reason to expect erotic material are forbidden in any case (Acceptable Use section 3.4).
7 Remuneration and responsibility
Copy link to “7 Remuneration and responsibility”- We credit the remuneration for an item of content to the uploading creator alone. Those taking part have no claim against us to a share.
- Agreements about splitting revenue, about fees or about linking to one another are private agreements between those involved; we neither administer, check nor enforce them, and we take no part in disputes. We recommend putting them in writing before recording.
- For co-creators: each publishes what they upload in their own account, and marking one another as co-creators links the profiles (Creator Terms section 11.2). There are no shared accounts.
- The uploading creator is responsible for holding every right (copyright, personality rights, consents) and indemnifies us against third-party claims arising from missing or invalid consents (Creator Terms section 13) — so far as the defect is their responsibility.
- We may at any time ask for proof of the identity and consent of everyone taking part. Where it is missing: the content is removed, the remuneration connected with the breach is retained, and the account may be restricted (Moderation section 7).
8 Prohibited practices
Copy link to “8 Prohibited practices”- publishing without consent, or after it has been withdrawn — a zero-tolerance breach for content not suitable for all audiences (Acceptable Use section 2.2, NCII Takedown)
- consent given by a third party, under pressure, for payment to the creator, while intoxicated, or without knowing what the content is
- declaring someone a bystander when they are in fact taking part; getting round the count of people
- covering a face to conceal that someone is unverified (Acceptable Use section 2.9)
- AI alteration of a real person without their separate agreement (Acceptable Use section 4.2)
- passing invitation links to third parties; a creator creating co-performer accounts themselves
Breaches lead to removal, retention, suspension and — where coercion or minors are involved — a report to the authorities.
9 Data protection for people taking part
Copy link to “9 Data protection for people taking part”We give people taking part the information required by Articles 13 and 14 GDPR when they are invited (Privacy section 15.1). The creator sees the person’s verification status, never their identity document data; fans see only their stage name where the person is a creator, and otherwise nothing. Co-performer accounts can be deleted at the person’s request once the record-keeping periods expire; records under § 2257 are unaffected by that.
10 Updates and contact
Copy link to “10 Updates and contact”Where a change is substantial we tell you 30 days beforehand (creators at least 15 days, Article 3 of Regulation (EU) 2019/1150); changes to the consent text apply only to new consents. The current version is at legal.desioart.com/co-performer.
